What are the penalties?

Jail

Sex crimes carry heavy penalties in our state, and you should immediately contact a lawyer if you have been charged. A first-time conviction for indecent assault and battery on a person over 14 can bring up to 30 months in jail or 5 years in prison. If the victim had a mental disability or was elderly, the sentence can increase to 10 years. These kinds of punishments can change the rest of your life, which is why it is so important for you to avoid a conviction.

According to Massachusetts Law §265.13H (2011), the prosecution must convincingly demonstrate that you:

  • Assaulted the victim
  • The assault was indecent
  • The victim was at least 14 years of age at the time of the incident.

However, the courts do not have a specific definition for what qualifies as “indecent,” and our firm may be able to use this to support your defense.

Building a Strong Defense Plan

Depending on the circumstances of your incident, we may be able to show that any physical contact that did occur was not indecent according to societal norms and modern standards. As the prosecution will have to prove that you are guilty beyond a reasonable doubt, they must demonstrate that you intended to engage in the touching and that you knew it would be harmful or offensive to the victim. They will also have to prove that there was no excuse or justification for the touching.
